Some College Athletes Get NIL, Others Get Nil

The landscape of college athletics has changed considerably over the past few years, with student-athletes finally able to receive compensation for the use of their Name, Image, and Likeness (“NIL”) rights without forfeiting their amateur status. Before this change, the National Collegiate Athletic Association (“NCAA”) enforced strict rules prohibiting college athletes from receiving any sort of remuneration, imposing sanctions on the athletes and universities alike when its rules were broken. Now, student-athletes can receive millions in compensation, even before turning professional, through NIL deals and potentially a sort of revenue sharing payment from the schools themselves.

What Is the Status of Non-Compete Agreement in the US?

The Federal Trade Commission (“FTC”) issued its Non-Compete Clause Rule (the “Final Rule”) on April 23, 2024, prohibiting employers from enforcing non-competition agreements against employees and Independent Contractors. Employers and employees alike have been waiting to see whether the Final Rule would withstand the immediate and numerous legal challenges seeking to enjoin enforcement of the rule in advance of its effective date, September 4, 2024.

Revisiting the Joint Employer Rule…Again

On July 19, 2024, the National Labor Relations Board (“NLRB”) dropped its appeal of a decision rendered by the United States District Court for the Eastern District of Texas, which invalidated the NLRB’s proffered definition of “joint employer.” At least for now, employers maintain some sense of clarity as to whether or not they will be considered a “joint employer” over an employee.
